Puvarasan Balaiyah, proprietor of Puvarasan & Associates, was invited as a speaker for the legal talk titled “Remand Hearings: A Practical Guide for Criminal Lawyers” held at the Negeri Sembilan Bar Auditorium on 29 April 2025 at 3:00 PM. The session targeted members of the legal profession who sought practical insight into the procedural and strategic aspects of remand hearings.
The talk focused on several key areas:-
Understanding the legal principles governing remand under Section 117 of the Criminal Procedure Code (CPC) and Article 5 of the Federal Constitution.
Practical preparation for remand hearings, including gathering necessary documents, assessing the client’s condition, and identifying the appropriate legal approach.
Recognizing grounds for objecting to remand applications, such as lack of necessity, medical concerns, or procedural irregularities.
Puvarasan emphasized the importance of remand hearings as the judiciary's first checkpoint in safeguarding the liberty of the accused, noting the requirement for judicial oversight when the police seek to extend detention beyond 24 hours. The legal framework discussed included Sections 23, 28A, and 117 of the CPC, along with precedents such as Hassan Marsom v Mohd Hady Ya'akop [2018] 7 CLJ 403 and Leonard Teoh v PP [2012] 10 CLJ 104.
The talk also covered:
Effective communication with clients in custody.
Strategic legal submissions in court, supported by relevant facts and law.
A Q&A session concluded the event, allowing participants to exchange perspectives on legal strategies and practical issues encountered in remand proceedings.
